Smart Defibrillators (AED's) May Cause More Deaths Than Old Defibrilators

A new study reveals that a move among many hospitals to automated external defibrillators (AEDs) may be contributing to a higher rate of fatalities than would have been the case with older defibrillators. About 1000 patients are said to die annually thanks to AEDs.

Defibrillation is the stimulation of the heart with a therapeutic stream of current between two electrodes. The purpose is to recalibrate a normal heart beat for an individual suffering from cardiac arrhythmia or other similar conditions. Some arrhythmias are "nonshockable" rhythms, meaning they are not amenable to defibrillation. These include asystole, or flatlines. In the interest of telling between nonshockable and shockable rhythms, a professional would normally be required to use an external defibrillator. AEDs were invented to act as smart defibrillators, so anyone can use them in case of emergency. However, the results are not encouraging.

Part of the reason for AEDs' weak performance is the time it takes to apply the AED's pads to the patient from the moment the AED is accessed: 46 to 52 seconds. With only a few minutes to save a patient's life, this has proven to be too long of a time span.

The study, published in the Journal of the American Medical Association, tracked 11,700 patients with cardiac arrests across the United State from 2000 to 2008. Patients survived 16.3% of the time when AEDs were used, but survived 19.3% of the time when AEDs were not used. When controlling for just shockable rhythms, AEDs saved 38.4%, compared with the 39.8% survivability rate without AEDs.

Can You Bring A Wrongful Death Case in NY Without Pecuniary Loss?

Your loved one has died in New York, and you are devastated. You believe that your family member died because of someone's wrongdoing. You want answers.

In cases where your loved one was elderly and not working, then it becomes difficult, if not impossible, to show that there was a financial loss to the family as a result of their death. This is known as "pecuniary loss." In NY, one of the elements of proving a wrongful death case include asking "What was the financial loss to the family because your loved one died?"

Where the person was not employed, then there is no way that we can show an actual financial loss to the family, unless there was some other source of income that they were receiving on a regular basis.

Another element that we look at in a wrongful death case in New York is to determine whether your family member suffered pain, from the time of the wrongdoing until their death. If they were under anesthesia during the course of surgery, and something happened during surgery to cause their death without them ever waking up, then it would be difficult, if not impossible, to show that they were conscious and aware of what was happening. In order to prove conscious pain and suffering and be able to include that in a claim for wrongful death, we must be able to show some level of awareness and pain. The NY Courts have held that this can include moaning, groaning and responses to painful stimuli.

In this case, the doctor told the patient that she needed a hysterectomy to remove her uterus because she had invasive cervical cancer. After surgery, the pathology results revealed that this patient never had any type of invasive cancer. In this case, the failure to diagnose breast cancer in a young woman with a husband and three children cost a group of doctors $4.5 million.

What happened? The woman had complained of a lump in her breast and she was correctly referred for a mammogram. The mammogram results were interpreted as "normal" but her lump continue to grow. She was then referred to a breast surgeon for biopsy.

Unfortunately, the surgeon failed to biopsy the actual lump, and instead got surrounding tissue which was read as "normal."

After being reassured by various doctors that she only had cystic breasts and there was no cancer, she gave no further thought to her growing mass in her breast. Finally, the mass became so pronounced that upon further evaluation, she learned that she had stage IV breast cancer.

You're in labor. You're attached to a fetal monitor so the nurses and doctors can see how your baby is doing during your labor. Your spouse is watching two wave patterns on the monitor; one is the baby's heart-rate, the other is the contraction pattern from the outside of your uterus. Do you know what the tracings mean? Most likely, you don't.

The obstetrician and the obstetrical nurses are supposed to be watching those fetal tracings to make sure the baby is reacting properly every time you have a contraction. The external and internal fetal monitor are designed to detect whether the baby is in distress every time there is contraction. Problems can arise when there is a failure to timely recognize a baby who is in distress for an extended period of time.

Lack of oxygen to the baby, also known as hypoxia, can occur with fetal distress, which can, in some cases, cause brain injury to the baby. Watch the video to learn more.

A woman from Brooklyn, New York had complained repeatedly to her doctor that there was blood in the toilet bowl whenever she urinated. The doctor did a urinalysis on a few occasions but failed to understand the results. He also failed to refer the patient to a urologist when she continued to complain of seeing blood in the bowl. When she was finally diagnosed, she had stage 4 bladder cancer which ultimately killed her.

You walked into the hospital thinking you were having routine surgery. The doctor told you Everything would be fine. The nurse wants you to sign informed consent papers, and reassures you that everything will be all right. You come out of the hospital believing that everything was done fine, and now you start to have post-operative complications that do not go away. You call the doctors office to get answers and help for your problems, and are told that it is nothing to worry about. You are in pain and your condition worsens, but still your doctor tells you its nothing to worry about. What do you do?

Chances are you will go to an emergency room to get evaluated.
