The best person to speak to about your current medical condition is obviously your current treating doctor.

When evaluating a possible medical malpractice case in New York, it is critical to understand what problems you have today, what medical treatment you are getting now, what treatment you will need in the future and what your prognosis will be for the future.

Unfortunately, most treating physicians refuse to pick up the phone and speak to me. Why is that?

It's because they don't want to get involved in a lawsuit. They are afraid they may also be a target of a potential lawsuit. They don't want to get a reputation of helping an attorney who represents injured victims. They also don't want to take time out of their busy day to speak to an attorney about a patient of theirs.

Some will gladly pick up the phone to help out their patients. However, the majority want nothing to do with an attorney even though the treating doctor is not the focus and target of a potential lawsuit.

If you're treating doctor refuses to talk to me, then I must obtain all of your medical records and have a qualified medical expert comment on your current problems, your current treatment and your prognosis.
