Why Your New York Medical Malpractice Lawsuit Will Take 2-3 Years
Gerry's Educational Medical Malpractice Website
You are contemplating bringing a lawsuit for claims against a doctor or hospital and you want to know how long the lawsuit will take. In order to understand how long a lawsuit takes, it's important to understand the different procedural steps that occur in a medical malpractice lawsuit in the state of New York.
Typically, lawsuits involving medical negligence or medical malpractice will take 2-3 years from start to finish.
There are many steps in the litigation process and it all begins with a thorough and detailed investigation into whether or not you have a basis for valid case.
That investigation includes obtaining all of your medical records together with having a medical expert review and confirm that there is a valid basis to proceed forward.
Once that happens, there are a number of steps that must occur in order to begin the lawsuit. Once your lawsuit has started, there are specific steps that must occur before we can let the court know that all of the people involved in the lawsuit have answered the complaint and we are now ready to schedule discovery.
