Boating Accident-A Case I Lost at Trial

http://www.oginski-law.com

Listen in as Gerry Oginski, an experienced New York personal injury and accident attorney practicing law in Manhattan, Brooklyn, Queens, Bronx, Staten Island, Nassau, Suffolk & Long Island explains why most attorneys who try cases will lose a case from time to time.

If the attorney you seek tells you he's never lost a case, either he does not try many cases, or he's the best attorney in the State.

Learn how a woman who went out on a pleasure boat for the day suffered a broken leg when the owner of the boat didn't do the right thing when another boat passed by. Despite having boating experts to confirm and support our case, a jury in Nassau County Supreme Court, the trial level court, determined that we had not proven that the owner of the boat was careless. Accordingly, my client received no compensation for her injuries. She truly believed that the only reason she suffered a fractured leg was because of the owner's wrongdoing. A jury disagreed.

Slip & Fall on Ice in NY-Can You Get Money For Your Injury?

http://www.oginski-law.com

Listen in as Gerry Oginski, an experienced New York negligence and accident attorney practicing law in Manhattan, Brooklyn, Queens, Bronx, Staten Island, Long Island, Nassau & Suffolk explains what happened to a woman on her way to work on Staten Island. Learn why proving 'notice' is essential to determine if the property owner may be responsible for your injury.

Sometimes, you will have to resort to litigation to obtain compensation for the injuries you suffered since the owner of the property or the snow plow operator refuses to accept any responsibility for causing or contributing to your accident. In that case, you may have to sue both the property owner and the individual or company that removed the snow or ice.

Watch the video to see how Gerry was able to prove that both the owner of the property and the snow plow operator were responsible for a dangerous icy condition. Both failed to recognize that piles of snow at the top of a hilly driveway that melted during the day and re-froze in the evening, would create sheets of thin ice making the parking lot a very dangerous place.

NY Medical Malpractice-Erbs Palsy Birth Injury; What Is It?

http://www.oginski-law.com

Gerry Oginski, an experienced New York Medical Malpractice trial lawyer practicing law in Manhattan, Queens, Brooklyn, Bronx, Staten Island, Long Island, Nassau & Suffolk, explains what Erbs palsy is and the steps that doctors use to prevent it from happening. The problem arises when an obstetrician fails to recognize shoulder dystocia. This means that the baby's shoulder is stuck behind the mother's pelvic bone.

If the obstetrician pulls in the baby's head without realizing that the shoulder is stuck, the nerves running from the neck to the arm can be stretched and in severe cases, torn. This results in a limp and useless arm for the baby which, depending on the severity of the injury, may be permanent.

Surgery may be required in extreme cases where the nerve has been torn or severed.

Learn what options a doctor has once shoulder dystocia is recognized. Importantly, all of the accepted obstetrical maneuvers to relieve the stuck shoulder do not involve placing hands on the baby's head to pull the baby out. Watch the video to learn more.
